This Disclaimer (“Disclaimer”) is an integral part of the Ganga Club Terms of Service (“Terms”) and applies to all services, games, content, and applications provided by Ganga Club (collectively referred to as “Ganga Club,” “We,” “Us,” or the “Platform”).

BY CONTINUING TO ACCESS OR USE GANGA CLUB’S SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND FULLY ACCEPT ALL TERMS AND CONDITIONS STIPULATED IN THIS DISCLAIMER.

2. Interruptions and Technical Errors

We do not warrant that the Services will be continuously available, uninterrupted, timely, secure, or error-free. Access to the Services may be temporarily suspended without prior notice due to system failures, maintenance, repairs, or reasons beyond Ganga Club’s reasonable control. Ganga Club shall not be liable for any damages resulting from interruptions, delays, data loss, or data transmission errors.

3. Accuracy of Content

All information, statistical data, odds (where applicable), or results displayed on the Platform are for informational and entertainment purposes only. Ganga Club does not guarantee the accuracy, completeness, or timeliness of such information. Users are solely responsible for verifying any information before relying on it to make any financial or gaming decisions.

4. Financial Loss Risk

By using games featuring real money transactions or staking on Ganga Club, You acknowledge and accept that there is a risk of losing actual money. You agree that participation is voluntary and is done entirely at Your own choice, free will, and risk. Ganga Club shall not be held liable for any loss or damage incurred, directly or indirectly, from Your use of real money on the Platform.

5. Financial Advice and Future Results

Ganga Club, its employees, affiliates, partners, or agents do not provide any financial, tax, or legal advice. No statement on the Platform shall be construed as a promise or guarantee of future financial results, profits, or earnings. You are solely responsible for managing Your budget and making Your own financial decisions.

6. Tax Liability (TDS, GST)

You are solely responsible for any and all taxes, including but not limited to Tax Deducted at Source (TDS), Goods and Services Tax (GST), and income tax, related to deposits, transactions, and prize winnings received from Ganga Club under the prevailing laws of India or Your jurisdiction. Ganga Club acts only as the statutory tax deductor where mandated by law and is otherwise fully absolved of any liability arising from Your personal tax calculations or filings.

III. LEGAL AND JURISDICTIONAL DISCLAIMER (STATE LAWS)

7. Compliance with Local Laws

The primary responsibility lies with You to ensure that accessing and using Ganga Club Services is legal within the city, state, or country where You reside. Specifically in India, gaming and wagering rules and laws may vary significantly across different states. Ganga Club disclaims all liability if You violate any local law or regulation while using the Services.

8. Restricted Jurisdictions (Non-Permissible States)

Ganga Club may block access for Users originating from restricted jurisdictions where real money games or games of skill are prohibited or strictly regulated. If You knowingly access or use the Services from a Restricted Jurisdiction by employing VPNs, proxies, or other location-masking methods, You are in breach of the Terms and this Disclaimer. Ganga Club bears no liability for any claims or losses arising from such unauthorized use.

9. Disclaimer Regarding User Conduct

Ganga Club accepts no responsibility and disclaims all liability for the conduct of any user on the Platform, including but not limited to:

  • Any acts of cheating, collusion, or fraud carried out by other users.
  • Inappropriate, offensive, or defamatory content posted by other users.
  • Any actions by users that result in financial, psychological, or physical harm to You.

IV. OTHER DISCLAIMERS

Ganga Club is not responsible for any failure, damage, or data loss to Your equipment, software, or data caused by viruses, software bugs, malware, or other harmful components during the access of the Services. You bear full responsibility for the installation of protective software and device compatibility.

The Services may contain links to third-party websites, services, or content. These links are provided solely for Your convenience. Ganga Club does not control, endorse, or assume responsibility for the accuracy, legality, content, or security of any third-party websites or services. Accessing any third-party links is entirely at Your own risk.

12. Force Majeure

Ganga Club shall not be liable for any delay or failure to perform its obligations under this Disclaimer if such delay or failure is caused by circumstances beyond Our reasonable control, including but not limited to: acts of nature, war, terrorism, fire, flood, epidemic, strikes, power outages, telecommunication network failures, or actions of government or regulatory authorities.

V. MAXIMUM LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL MAXIMUM LIABILITY OF GANGA CLUB (AND ITS AFFILIATES, EMPLOYEES, PARTNERS, AND AGENTS) FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES SHALL NEVER EXCEED THE NET AMOUNT YOU HAVE TRANSACTED (DEPOSITS LESS WITHDRAWALS) IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE DATE THE CLAIM AROSE.

Any liability for indirect, incidental, special, punitive, or consequential damages (including loss of profits, data loss, or loss of goodwill) is fully and completely disclaimed, even if Ganga Club has been advised of the possibility of such damages.

You agree that the limitations of liability set forth in this Disclaimer are fair and reasonable.
